19.-As a non-Spanish private company established in the EU, do we have to submit the Spanish or the English translation of those documents? 17/10/2019 10:16h

16.- We write in order to receive some more clarifications concerning the "AntiSUPERBUGS PCP": 1.- The submission has to be done ONLY through the online platform within 28/10/2019 13.00 CET, right? 2.- Each single document (Form, Annex, other documents required, declarations etc) from each single Envelope A, B,C has to be firstly signed in original paper form, then scanned and transformed in PDF-format and finally digitally signed as well and uploaded into the platform? Can you confirm this or better explain the process? In case od digital signature, for the subcontractor Form do we have to put double digital sign (the Bidder and the Subcontractor)? 3.-Since it is written that you need "original of the notarized deed of power of attorney" for example, we have to intend that all the documentation submitted on the platform (which is PDF copy) should also be sent in original paper format to AQuAS address as well and within the deadline? Can you please clearly or better explain this point. 4.-"The Spanish or Catalan translation of document 1.2.3.4.5. (in case of non-Spanish organization from member states) accompanied by FORM0-1 where it is recognized that it is a faithful reflection of the original" (as stated in "AnnexIII"). Does it mean that we have to produce these documents FIRST translated in English (being the official language) and accompanied by FORM0-1 stating it is a faithful translation of the original in ITALIAN and THEN again in Spanish accompanied one by one by another FORM0-1 stating that is is a faithful translation of the original in ITALIAN again? Is it correct? Do you need both translation in English and Spanish of these documents or only ONE is enough? And each one of the 5 documents has to be accompanied by a single FORM0-1 or one FORM0-1 can be ok for all this group of documents? 15/10/2019 12:57h
16.1.- In agreement with section 4.1.1 of the Request for Tender ( file name: Administrative clauses), "The entities interested in participating in the ANTI-SUPERBUGS PCP shall submit a bid by means of the Digital Envelope Tool in the AQuAS procurement webpage (https://contractaciopublica.gencat.cat/perfil/AQuAS ) hosted at the Public Contracts web Platform of the Government of Catalonia.

16.2.- In agreement with section 4.1.1.2 of the Request for Tender (file name: Administrative clauses),
all the documents that are part of the offer have to be signed digitally
in accordance with the provisions of the Regulation (EU) No 910/2014 of the European Parliament and of the Council, of 23 July 2014, on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC. In conclusion, it is not necessary the physical signature of the documents or their subsequent scanning, you just need to convert the document into PDF format and sign it electronically.

With regard to the Form 0-5 (Subcontracting statement), in agreement with section 3.2.3.1, this document must be signed by the subcontractor in addition to the bidder, although its presentation is reserved to the four tenderers that have obtained the highest score, in agreement with section 4.2.3.2 of the Request for Tender. For the submission of the offer, it is enough to identify the subcontractor in the DEUC, as provided in section 4.2.1.2.1 ("In case the Bidder relies on the capacities of other entities as Subcontractors to perform part of the work, the Subcontractors shall identify them in the ESPD, if they are known by the time the offer is submitted.").

16.3.-In agreement with section 4.1.1 of the Request for Tender (file name: Administrative Clauses), the entities interested shall submit a bid by means of the Digital Envelope Tool in the AQuAS procurement webpage (https://contractaciopublica.gencat.cat/perfil/AQuAS) hosted at the Public Contracts web Platform of the Government of Catalonia. Therefore, all documents must be in digital format, without prejudice to being able to require the original document to the bidder in order to verify the originality of the document.

However, as indicated in the previous question (question 16.2), the presentation of this document is reserved to the four tenderers that have obtained the highest score, in agreement with the Section 4.2.3.2 of the Request for Tender.

16.4.-In agreement with section 4.1.4 of the Request for Tender (file name: Administrative Clauses), "All the offers submitted in every Phase must be submitted in English. Bidders can also provide these documents in Catalan or Spanish".

Therefore, if all the documents are translated to English, the subsequent translation of the documents into Catalan or Spanish is not necessary.

However, the documents 1, 2, 3, 4 and 5 (identified in the "I. General Overview" section, " Documentation to be provided to be awarded with the Framework Agreement and Phase 1 Contract" in Annex III, and which are based on section 4.2.3.4 of the specifications, will be presented by the four tenderers that have obtained the highest score in accordance with the provisions of section 4.2.3.2 of the Request for Tender.

18.- Since the excel budget support allows to enter values for phase 2 and 3 and we are in the proposal evaluation for phase 1, is it necessary to estimate values for phase 2 and 3? 15/10/2019 12:33h

17.- 17.1.-All of the administrative Forms (both all the different FORM0 and FORMA series, along with these 1,2,3,4,5, documents required have to be put all together inside the Envelop A, right 17.2.-In "Annex III" under "Documentation to be provided to be awarded with FA and Phase 1 Contract" there is a list of documents proving technical ability, economic soundness, R&D services, team involved, Commitment to contract a CRO for Phase 3 a tools and technical equipment. In another document, it is reported that these documents are not required now, but only to the 4 winning bidder. Is it correct? So we have NOT to produce this list of document now, neither to fill in the FORMA-2, right? 17.3- Do you need also the FA and Phase 1 templates signed in each page for acceptance of its content as well or it is not required now? 15/10/2019 12:30h
17.1.- The documents to envelope A and the forms of the Call for Tender (Tenders Forms) have to be completed and uploaded together in a PDF in envelope A to the Digital Envelope. However, the documents 1, 2, 3, 4 and 5 (identified in the "I. General Overview" section, " Documentation to be provided to be awarded with the Framework Agreement and Phase 1 Contract" in Annex III, and which are based on section 4.2.3.4 of the specifications, will be presented by the four tenderers that have obtained the highest score, in accordance with the provisions of section 4.2.3.2 of the Request for Tender.

17.2.- In agreement with section 4.2.1.2.2 of the Request for Tender (file name: Administrative Clauses), "The information and evidence of the legal capacity, the information and evidence of non-disqualification from contracting with the public sector under article 71 LCSP and/or the exclusion grounds listed in the ESPD of the tender, the information and evidence of technical ability and economic and financial soundness of the Bidder would be only requested to the four best ranked Bidders by the Tendering Board, after the Envelopes B and C have been assessed, as provided under Section 4.2.3.2 of this RFT." All the documentation mentioned above does not need to be presented in the initial submission of the offer.

17.3.- In agreement with section 4.2.4.3 of the Request for Tender ( file name: Administrative Clauses), "As a result of the award decision, the Lead Procurer will admit up to a maximum of four (4) Bidders to join the Phase 1 of the ANTISUPERBUGS Procedure. They will be asked to sign the FA and the Phase 1 contract." The final award decision shall be delivered by the Lead Procurer within a period of approximately sixty (60) days after the final date for receipt of tenders. The future bidder does not have to sign the Framework Agreement or the Phase I contract until the award decision of the main purchaser.


15.-We are interested in collaboration with a sensor based organsation to produce an solution that would work well in an modern hospital. Can we reply to this tender as a separate lot to supply the alerting and deployment or should we tender as a preformed collaboration? 23/09/2019 10:22h

Additionally, as per explanatory report (https://contractaciopublica.gencat.cat/ecofin_pscp/AppJava/portalfileretrieving.pscp?reqCode=retrieveFile&docHash=a119b760316be3dec29cd1d4485d3995&fileId=51105911&capId=206757&idTS=26810044), it is important to clarify that the tender is not separated in lots.
14.- We are an Israeli company. Can we submit a tender? 23/09/2019 10:12h
In Agreement with sections 1.1.3 and 5.3 of the Request for Tender: "PCP is open to all operators on equal terms, regardless of the size, geographical location or governance structure. There is, however, a place of performance requirement that they must perform a predefined minimum percentage of the contracted R&D services (51% in this case) in EU Member States or Horizon 2020 associated countries."

13-For Completing the Envelope C/ FORM C, it says there is an excel sheet that is available for download which is not visible in any link that was provided in the for 1.3 Could you provide with a link for the excel sheet 23/09/2019 10:06h
The excel file is available in the Envelope C once you register your offer in the contracting platform (clicking on Submit digital Envelope). You can also see its pdf format in the Annex 3 to the Request for Tender.
12.- We have the following questions regarding the Antisuperbugs PCP call for tender: 1.The bidders have to be a consortium or can they be individual entities? In a consortium, is there a minimum and maximum limit for the number of entities? 2.Should the bid include a proposal of R&D services for the 3 phases of the project? 3.The consortium should include all the partners needed since phase I until phase III? Or can we form different consortia for the different phases? 4.What is the duration of each of the 3 phases? 5.Which is the expected TRL for the technology at each phase? 23/09/2019 09:57h
1. In agreement with section 3.2 of the Request For Tender (file name: Administrative clauses), "Tenders may be submitted by autonomous investigators and entities, individually or in collaboration with others. The latter can involve either submitting a joint tender or subcontracting, as provided below". For more details please refer to section 3.2.2 and FORMs 0-3 and 0-4 of the Annex III to the Request For Tender. In the case of consortia, there is no specific requirement regarding the minimum or maximum number of entities.

2. The information contained in section 4.2.1 of the Request For Tender clarifies the content that must be included in the proposal and specified that should cover the three phases: "(¿) Envelope B shall contain a preliminary description of an innovative solution (¿) Description of the technological development plan covering the full PCP procedure from Phase 1 to Phase 3, deliverables, milestones and project schedule (¿)

In the section 4.2.1.3. it is mentioned that "More detailed information for the Phase 2 and 3 offers (in particular on the technical implementation plan, updated business plan and list of IPRs) will be provided in the correspondent invitations."

In Annex III to the Request For Tender, in the 'FORM C: Financial proposal model and any other automatic awarding criteria' it is specified that the Bidder will submit a "BINDING PRICE FOR PHASE 1 AND ESTIMATED PRICE FOR PHASES 2 AND 3".

In sections 4.3.2.2. and 4.4.2.2. related to the technical offer to be submitted to Phase 2 and Phase 3, it is said: "Bidders may vary the offered values of the technical/performance Indicators within the limits of their initial offer, so that they can always improve them but they not make them worse.".

And in sections 4.3.2.3. and 4.4.2.3. related to the financial proposal to be submitted to Phase 2 and Phase 3, it is said: "Bidders may always improve their financial proposals in comparison with their original offers but they not make them worse."

3. Please refer to section 3.2.2 and FORMs 0-3 and 0-4 of the Annex III to the Request For Tender. According to Annex III to the Request For Tender, the different entities of the consortium agree "to set up a team to participate jointly along the ANTI-SUPERBUGS PCP Procedure". These forms need to be signed when submitting your proposals to join the tender and, pursuant to Section 3.2.2.1, as a general rule, "The group of tenderers must assume joint and several liability for the performance of the FA and the derived Contracts".

Nevertheless, please note that, in accordance with the information contained Section 3.2.2.2, the Tendering Board may exceptionally propose to authorize in writing changes in the composition of a consortium that tendered at the Call for Tenders of the ANTI-SUPERBUGS PCP Procedure and/or the formation of a new consortium different from the ones that tendered at the Call for Tenders of the ANTI-SUPERBUGS PCP Procedure.

4. The duration of the whole procedure is detailed in the section 2.2. of the Request for Tender as well as in Annex I to the Request For Tender:
Phase 1 contract lasts 10 weeks;
Phase 2 contract lasts 20 weeks and;
Phase 3 contract lasts 34 weeks.

5. The Technology Readiness Level (TRL) is not specified. The objectives, as well as the output and results expected from each phase are stated in Annex II. to the Request For Tender
11.- In the description of the tender, it is specified that it is required the development of a technology that detects volatile organic compounds associated with specific types of bacteria. We wonder, if it is possible to offer other types of technologies, highly effective in detecting these bacteria, but where the principle is not based on the measurement of volatile organic compounds. Economic operators' bids must comprise volatile organic compounds (VOC) detection technologies, which may work together with other types of technologies provided that such technologies allow them to reach better performance and still fully comply with ANTI-SUPERBUGS specifications and requirements.

As specified in the Glossary of the Challenge Brief (file name in the platform: "Technical prescriptions", accessible at the 'Most recent correction tab' here: https://contractaciopublica.gencat.cat/ecofin_pscp/AppJava/en_GB/notice.pscp?reqCode=viewCn&idDoc=50080299&version=51105101&lawType=2 ): "(¿) Different technologies are used to detect the volatile organic compounds and they depend on the detection principle (according to the nature of the physical signal they measure), sensor types and sensitive materials (¿)".

Consequently, ANTI-SUPERBUGS buyers group is not requiring the development of a specific technology but indeed requiring the detection of volatile organic compounds (VOC) without specifying the technology. Through VOC detection ANTI-SUPERBUGS buyers group enables the satisfaction of one of their main identified common needs: the continuous real time detection of contaminations/colonisations of fomites (e.g.: patient exhaled breath, skin flora and surfaces in contact with the patient (e.g. as linen or gowns)) and hospital environments, without making use of any intrusive or invasive sampling.
10. - Having read the OJEU notice above and visited the https://antisuperbugs.eu website, it is not clear which documentation needs to be presented to formally express an interest in the Pre Commercial Phase of this project, and therefore be assessed to enter Stage 1 of the Anti Super Bugs challenge process. If you need to ask questions and queries on the bid procedure follow the instructions below:

In the case of winning the tender, do the money take place at the beginning of the action in order to carry it out or when it is finished? 07/08/2019 17:13h
As described in section 5.2 of the Request for Tender, a given percentage will be paid at signature of a given phase contract and the remaining amount will be subject to satisfactory completion of the deliverables and milestones of said phase.
"Payments corressponding to each PCP phase will be subject to satisfactory completion of the deliverables and milestones for that Phase."
Based on our experience, what we could offer is the implementation of software that we have demonstrated in several US hospitals that reduce the cases of sepsis or infections acquired in the hospital, as well as help implement processes that reduce it or prevent it from acquiring them based on individualized risk. Part of the tenderness is about the creation of a device for the detection of infections, part in which we have no expertise. Can you create collaborations with other companies? We are an American company with workers in Europe. Would this be an impediment to apply if more than 51% of R & D is done here? 07/08/2019 17:04h
